Rationale:
National Hispanic Heritage Month celebrates the histories, cultures, and contributions of American citizens whose ancestors came from Spain, Mexico, the Caribbean, and Central and South America. Though it extends the equivalent of an entire month, it does not begin until Sept. 15. It ends Oct. 15. Why? It kicks off on the anniversary of independence for five Latin American countries – Costa Rica, El Salvador, Guatemala, Honduras and Nicaragua. Mexico’s independence day is one day later, Sept. 16, and Chile celebrates its independence Sept. 18. National Hispanic Heritage Month is honored throughout the country but has special significance in Natomas because nearly one of every three students here is Hispanic.

XIV.f. Approve the Williams Review Annual Report for 2016-17

Rationale:

As a result of the Williams v. State of California case in 2000, districts are required to report to the local county offices of education; the overall condition of school facilities, the number of teacher misassignments, and the availability of textbooks or instructional materials. Our District is required to submit an annual report as well as quarterly reports to the Sacramento County Office of Education on the number of Williams Uniform Complaints filed with our District in the four areas previously listed.

The Williams Review Annual Report for 2016-17 is submitted to the Board of Trustees. A summary of the report is below:

Six schools participated in Williams Visits in 2016-17.

The schools were:

  • American Lakes Elementary
  • Bannon Creek Elementary
  • Jefferson Elementary
  • Natomas High
  • Natomas Middle
  • Two Rivers Elementary

All schools reviewed were found to have sufficient textbooks.
No emergency repairs were found in schools reviewed.
There were twelve teacher misassignments reported of which one was not corrected. There were no complaints regarding textbooks and instructional materials filed pursuant to the Uniform Complaint Procedures in the District for the 2016-17 school year.
The District SARCs contained accurate information with a few missing elements.

Measure J Citizens’ Bond Oversight Committee (CBOC) member Jennifer Slay (appointed by the Board on March 11, 2015) has submitted her resignation effective August 28, 2017. The Board is asked to accept her resignation. Committee member Robert Moreno has joined a Senior Citizens Organization. He currently serves on the Measure J CBOC representing the Taxpayer Organization designation. Members may serve representing more than one designation as described in the Bylaws Section 5 Membership. The Board is asked to appoint Mr. Moreno to serve representing the Senior Citizens Organization designation. On March 8, 2017, the Board accepted a resignation from Anita Lopez. Ms. Lopez has continued to support the Measure J CBOC and attended the meetings held since action was taken on the resignation. She has rescinded her resignation and desires to continue her service on the committee. She has actively served on the Measure D CBOC since September 2014. The Board is asked to rescind the resignation and approve her re-appointment to continue serving her second 2-year term. Following these updates, there are six (6) active members remaining on the Measure J CBOC. Education Code requires a seven (7) member committee. Committee members and staff are reaching out to parents and the community to seek new members to fill the vacancy. The committee member list is attached showing member terms and designations.

The Natomas School Readiness Preschool Program currently holds a Child Care Center License, License number 343616548. Title 22 requires the applicant, Natomas Unified School District, to designate an individual to be responsible for enforcing and meeting the license regulations at the site of the preschool program, taking legal responsibility for the program. Such an individual then takes on the role of the administrator of the program throughout the licensing paperwork. He/she must have proof of attending Orientation Components I & III, as well as meet additional clearance requirements. Through a board resolution, the Board of Trustees may authorize the Superintendent to fulfill this responsibility and he may then designate someone else to act as the administrator. In order to meet the requirement of administrator of the program as required for the license application, and to understand the process and legal responsibilities, Lisa Claussen, Director of School Leadership and Support, has attended both Orientation Components I & III. A board resolution is needed to authorize the Superintendent as the administrator and for Lisa Claussen to be authorized as the Superintendents designee.

On May 18, 2017 a public notice was issued requesting proposals for Lease-Leaseback Construction services for the Paso Verde project. Eleven pre-qualified contractors submitted proposals. The proposals were reviewed and scored according to the selection criteria identified in AR 3311.2, Lease-Leaseback Contracts, which were approved by the Board on March 22, 2017.

After review of the eleven submissions, it was determined that The Boldt Company had the highest scored proposal. A Notice of Intent to Award was issued to The Boldt Company on July 20, 2017.

The contract consists of a Site Lease whereby the District leases the site to the contractor for $1 and a Facilities Lease whereby the contractor will construct the project on the site and lease it back to the District in consideration for the District making payments equal to the construction costs. The Facilities Lease also contains a financed portion of the project cost which is subject to interest, but which can be paid off early to avoid payment of interest. The Boldt Company will provide pre-construction services at hourly rates in the contract not to exceed $462,000. We then anticipate making two amendments to the Facilities Lease:

• First, there is certain staging work to be done that will include the construction of a road, for which DSA approval is not required. At this time the precise scope of work and location of the road cannot be known, but it may also include extending utilities from the existing road to the school site. We anticipate bringing a first amendment to the contract back to the Board for approval that will set forth the scope, price and time for completion.

• Second, once DSA approval is obtained and a price and schedule are finalized with the contractor, we will bring a second amendment to the contract back to the Board for approval that will set forth the scope, price and time for completion.

Education Code requires a district close its books and adopt the report of financial activities and position by September 15th of each year for the preceding fiscal year. This information is submitted to the Sacramento County Office of Education and the California Department of Education for review. The attached financial report is designed to provide the Board of Trustees with a general overview of the District's finances and to show in detail through various state reports the District's accountability for the money it receives and expends. Included in the attached packet is an executive summary that is accompanied by the District's financial activity, which is followed by the required State reports in their entirety. Later this month, the District's independent auditors, Crowe Horwath LLP will audit the records contained in this packet and related financial documents. The 2016-17 Independent Audit Report prepared by the firm will be presented for review and action at the December 13, 2017 Board Meeting.
