Board of Trustees
Rationale:
Under the provisions of Education Code section 35142, our governing Board is required to set an annual organizational meeting.  At the November 8, 2017 Board meeting the Board took action to designate December 13, 2017 as the annual organizational meeting.  During the organizational meeting Trustees will elect school Board Officers (President, Vice President, and Clerk), as well as a County School Boards Association representative and a County Committee on School District Organization representative.  The County School Boards Association representative attends meetings at the County with representatives from all county school Boards.  The County Committee on School District Organization representative comes together with other representatives to review and approve proposals to change school district organization in the county.  The County Committee also considers petitions for transfers of school district territory, and establishes or changes school district governing Board Trustee areas.

Our current Board officers will continue their roles through the adjournment of the December 13, 2017 Board meeting.

At the time of the 2014 Facilities Master Plan (FMP), an update was planned to follow the post moratorium construction period. With the lifting of the moratorium and nearly $126 million in completed and in progress projects, the time was right for the FMP update. A first draft of a Facilities Financial Plan (FFP) will be presented as well. Only the Facilities Master Plan will appear as an action item for approval later in the Board Meeting Agenda. The Facilities Financial Plan will be further discussed at a future Board meeting.

Natomas Unified is creating a Construction and Building Trades Career Technical Education (CTE) pathway. The new pathway will require a large scale building that will provide indoor and outdoor space to accommodate construction equipment. The addition of the pathway will provide much needed relief for other programs that have high enrollment numbers.

Nacht & Lewis architects have provided extensive CTE architectural work, most recently designing the Natomas High School Engineering and Automotive rehabilitation. The agreement with Nacht & Lewis is in the amount of One Hundred Ninety Seven Thousand Three Hundred Fifty Dollars ($197,350.00).

XIV.m. Approve Change Order No. 1 with North American Technical Services for In-Plant Inspection of Modular Classroom Building

On July 19, 2017 an agreement with North American Technical Services was approved in the amount of Thirty Seven Thousand Two Hundred Dollars ($37,200.00). The agreement contracted North American Technical Services to provide Division of State Architect required in-plant inspection services of the new modular classroom building for NP3. The agreement did not include Ultrasonic Testing. During the in-plant construction of the building it was determined that Ultrasonic Testing was required. North American Technical provided the additional testing for the amount of One Thousand Seven Hundred Fifty Dollars ($1,750.00). Upon approval of Change Order No. 1 the full contract value will be Thirty Eight Thousand Nine Hundred Fifty Dollars ($38,950.00).

On October 3, 2016 the Board approved a contract with S.W. Allen Construction, Inc. for the culinary upgrades at Discovery High School. There were nine change orders and the final contract value was Two Million Four Hundred Sixteen Thousand Four Hundred Eighty Two Dollars and Seventy Cents ($2,416,482.70).

In order to close out the contract and contract payments, a Notice of Completion must be approved for this project. As required to begin the lien period, the Notice of Completion will be filed with the County of Sacramento post Board approval.

XIV.q. Approve Change Order No. 2 with Geocon Consultants, Inc. for New Science/Classroom Building at Heron School

Change Order No. 1 was approved on August 23, 2017 in the amount of Ten Thousand Five Hundred Seventy Two Dollars ($10,572.00).

Change Order No. 2 in the amount of Four Thousand Two Hundred Dollars ($4,200.00), addresses the need for additional geotechnical testing and observation that was required due to the wet subgrade soils in various areas of the project. Inclusive of change order No. 2 the entire contract value will be Forty One Thousand Five Hundred Two Dollars ($41,502.00).

XIV.r. Approve Change Order No. 1 with American Modular Systems for the New Classroom Building at Natomas Pacific Pathways Prep (NP3)

On September 14, 2016 a contract with American Modular Systems in the amount of Six Million Two Hundred Ninety Eight Thousand Dollars ($6,298,000.00) was approved for the modular construction of the NP3 new two story classroom building.

During the design phase of this building, revisions were made that resulted in a deductive change order of Seventy Two Thousand Dollars ($72,000.00). With the addition of Change Order No. 1, the new contract value is Six Million Two Hundred Twenty Six Thousand Dollars ($6,226,000.00).

Education Code, Governmental Accounting Standards Statement 54, and Board Policy 3100 requires the Governing Board to classify fund balances within five categories: 1. Nonspendable fund balance includes amounts that are not expected to be converted to cash, such as resources that are not in a spendable form (e.g., inventories and prepaids) or that are legally or contractually required to be maintained intact. 2. Restricted fund balance includes amounts constrained to specific purposes by their providers or by law. 3. Committed fund balance includes amounts constrained to specific purposes by the Board. For this purpose, all commitments of funds shall be approved by a majority vote of the Board. The constraints shall be imposed no later than the end of the reporting period of June 30, although the actual amounts may be determined subsequent to that date but prior to the issuance of the financial statements. 4. Assigned fund balance includes amounts which the Board or its designee intends to use for a specific purpose but do not meet the criteria to be classified as restricted or committed. The Board delegates authority to assign funds to the assigned fund balance to the Superintendent or designee and authorizes the assignment of such funds to be made any time prior to the issuance of the financial statements. 5. Unassigned fund balance includes amounts that are available for any purpose. The attached Resolution recommends $11,036,132 be designated as committed funds from the 2017-2018 General Fund ending balance as of First Interim reporting and uncommits $500,000 for the Pension Rate Stabilization Program from Resolution No. 17-19 to deposit into the pension trust fund.

On June 27, 2017, Governor Brown signed AB 119 into law. AB 119 requires that public agencies immediately begin doing three things:
  1. provide 10 days’ advance notice of any new employee orientation
  2. provide to the union the name, job title, department, work location, work, home, personal cellular telephone number, personal email address, and home address of any new employee within 30 days of hire or by the first pay period of the month following hire
  3. provide to the union the information in #2 every 120 days for all employees

AB 119 also requires that, upon request, the parties bargain over the structure, time, and manner of access of the union to a new employee orientation. Furthermore, AB 119 requires that public school employers meet and confer with unions, upon request, regarding the structure, time and manner of the access.

The District and CSEA entered into the attached MOU regarding AB 119. The MOU outlines procedures the District will follow to provide CSEA with the required new employee information, as well as detailed language stating that the District will annually conduct four classified employee orientation sessions and will provide CSEA with 45 minutes to meet with new employees during those orientations.

XVI.g. Approve the 2016-17 Bond Performance Audits for Measure D and Measure J

Proposition 39 stipulates the rules and requirements for a 55% General Obligation Bond. One of the requirements is an Annual Performance Audit consisting of an independent financial audit and independent performance audit. The Performance Audits for Measure D and Measure J will be presented to the Citizens' Bond Oversight Committee at the January 22, 2018 meetings. Gilbert Associates, Inc, independent auditors, tested bond expenditures, fiscal reports, and fiscal procedures. These tests indicated that the Natomas Unified School District expended Measure D and Measure J General Obligation Bond funds for the year ended June 30, 2017 only for the specific projects developed by the District's Board of Trustees and approved by the voters. The reports indicate that the District's bond expenditures, fiscal processes, and Citizen's Bond Oversight Committees are in accordance with the requirements of Proposition 39, as specified by Section 1(b)(3)(C) of Article XIIIA of the California Constitution. XVI.h. Approve Resolution No. 17-37, Awarding and Approving Site / Facilities Leases with XL Construction for the Jefferson Modernization Project

On October 16, 2017 a public notice was issued requesting proposals for Lease-Leaseback Construction services for the Jefferson Modernization project. Four pre-qualified contractors submitted proposals. The proposals were reviewed and scored according to the selection criteria identified in AR 3311.2, Lease-Leaseback Contracts, which were approved by the Board on October 11, 2017.

After review of the four submissions, it was determined that XL Construction had the highest scored proposal.  A Notice of Intent to Award was issued to XL Construction on November 14, 2017.

The contract consists of a Site Lease whereby the District leases the site to the contractor for $1 and a Facilities Lease whereby the contractor will construct the project on the site and lease it back to the District in consideration for the District making payments equal to the construction costs. The Facilities Lease also contains a financed portion of the project cost.

XL Construction will provide pre-construction services at hourly rates in the contract not to exceed One Hundred Twenty Thousand Nine Hundred Sixty Dollars ($120,960.00).  We then anticipate making two amendments to the Facilities Lease:

Once DSA approval is obtained and a price and schedule are finalized with the contractor, we will bring an amendment to the contract back to the Board for approval that will set forth the scope, price and time for completion

Natomas Unified is developing a building and construction trades Career Technical Education (CTE) pathway. The new CTE pathway will serve students from NUSD high schools. The program must be housed on a comprehensive high school campus in order to receive grant funding, and to maximize credit requirements.

The playfield area on the Discovery High School campus is logistically the best fit for the program. Discovery High School is an alternative high school, thus not meeting the comprehensive high school requirement. The playfield area will be transferred to Natomas High School's campus, satisfying the requirement for the program to be housed on a comprehensive high school campus. Resolution 17-38 addresses the transfer of the field space from Discovery High to Natomas High, as well as the future sharing of field spaces for activities and evacuation needs.

The Facilities Master Plan (FMP) was approved on June 25, 2014. Since approval Natomas Unified has seen the passage of Bond Measure J, the lifting of the building moratorium, and increases in home development and enrollment numbers. A commitment was made during the creation and approval of the June 2014 FMP that a need to revisit and update the plan would be necessary after the lifting of the moratorium and completion of initial projects. NUSD has completed nearly $126 million dollars in construction work since the 2014 FMP. Upgrades have occurred on nearly every NUSD campus. The 2017 update celebrates completed projects, targets K-8 conversions, revisits school site needs and addresses the need for a future high school. Approval of the Facilities Master Plan does not include approval of the Facilities Financial Plan.

Rationale:

Districts are required to annually submit a Declaration of Need for Fully Qualified Educators to the Commission on Teacher Credentialing (CTC) based on anticipated areas of need in case they are unable to find fully credentialed teachers that meet their needs.  Although the District is diligent in advertising, recruiting and hiring fully prepared teachers, there may be an instance where we would need to hire someone on an emergency or limited assignment permit in certain subject areas. We will have trained, qualified teachers, but some may need a provisional permit to work in their specific assignment. To qualify for as few as one provisional document from the Commission on Teacher Credentialing, the District must have attempted all of these search efforts. In order for our teachers to be eligible for provisional or emergency permits in certain authorizations, the Board must adopt a "Declaration of Need for Fully Qualified Educators." The Board and the public must have the opportunity to see the number of emergency permits the District reasonably expects to request from the California Commission on Teacher Credentialing and the reasons for such requests.

Our anticipated needs at this time are for staff serving in the following areas:

  • English Learners – We will continue to need emergency CLAD permits for some new hires, particularly out-of-state-trained teachers
  • Special Education - All Special Education positions continue to be recognized as statewide shortage areas
  • Science- All Science positions continue to be difficult to fill
